Acceptance of Terms

By downloading, installing, or using the 28 mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

28 is a period tracking and menstrual health app that helps users track their menstrual cycles, symptoms, and related health information. The App provides features including cycle predictions, symptom tracking, and health insights.

User Accounts

Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 17 years old to create an account
• Each user may only maintain one account

Account Responsibility

• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

Subscription and Payment Terms

Pro Subscription

• Pro subscriptions are available on a monthly ($2.99) or yearly ($19.99) basis
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Payment will be charged to your Apple App Store account
• You can manage and cancel subscriptions through your App Store account settings

Free Trial

• Free trials, when offered, automatically convert to paid subscriptions unless cancelled
• You can cancel during the trial period without charge
• Only one free trial per user account

Refund Policy

• Refunds are subject to Apple App Store policies
• We do not provide direct refunds for in-app purchases
• Contact Apple customer support for refund requests

Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Upload malicious code, viruses, or harmful content
• Reverse engineer, decompile, or disassemble the App
• Share your account credentials with others
• Use the App to harm, harass, or impersonate others

Medical Disclaimer

• Always seek the advice of your physician or other qualified healthcare provider with any questions regarding your health
• Never disregard professional medical advice or delay seeking it because of information obtained from the App
• The App's predictions and insights are estimates based on data patterns and may not be accurate for your individual situation
• If you experience a medical emergency, call emergency services immediately

Intellectual Property

The App and all content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the App or its content
• Use our trademarks or logos without permission
• Create derivative works based on the App
• Remove or alter any copyright or proprietary notices

Privacy and Data

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

Disclaimers and Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of the App, even if we have been advised of the possibility of such damages.

Termination

We may terminate or suspend your account and access to the App at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by deleting the App and contacting us to request account deletion.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada and the applicable provincial laws, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Canada.
